Terms & Conditions
These terms explain how Comlynx Communications Limited, trading as Data Cabinets Direct, supplies goods through this website and through other sales channels where these terms are incorporated into the agreement.
Last updated: 14 October 2026
Important: These terms distinguish between Consumers (individuals acting wholly or mainly outside their trade, business, craft or profession) and Business Customers (persons and organisations buying wholly or mainly for business purposes). Nothing in these terms removes or restricts any right or remedy that cannot lawfully be excluded.
1. About us
Data Cabinets Direct is a trading name of Comlynx Communications Limited, a private limited company registered in England and Wales under company number 03614183.
Registered office and returns address: Radley House, 482 Brays Road, Birmingham, West Midlands, B26 2RT, United Kingdom.
Telephone: 0121 605 8477. Email: correspondence@datacabinetsdirect.co.uk. You can also use our contact form.
2. Who these terms apply to
These terms apply to purchases from the Data Cabinets Direct website. They also apply to orders placed by telephone, email, quotation or purchase order where we have made them available and they have been incorporated into the contract.
A Consumer is an individual purchasing wholly or mainly for purposes outside their trade, business, craft or profession. A Business Customer purchases wholly or mainly for business purposes.
If you place an order on behalf of a business or other organisation, you confirm that you have authority to place the order on its behalf. This does not affect the statutory rights of anyone who qualifies as a Consumer.
Different provisions apply to Consumers and Business Customers. Additional terms may apply to a particular business quotation or agreed credit arrangement; any expressly agreed written terms take precedence to the extent of a genuine conflict, subject to applicable law.
3. Orders and formation of contract
Please check the goods, quantities, delivery address and total price before submitting an online order. The checkout allows you to review and correct your details before placing an order.
By submitting an order, you make an offer to buy the goods on the terms shown at checkout. An automated acknowledgement confirms receipt of your order, not our acceptance of it. Authorising or collecting payment does not, by itself, mean that we have accepted the order. A contract is formed when we send a dispatch confirmation, or otherwise expressly confirm acceptance to you. Where an order is accepted in stages, acceptance applies only to the goods expressly accepted.
Before acceptance, we may verify prices, promotions, supplier costs, stock, product suitability, delivery availability and charges, payment information and suspected fraud or misuse. We may decline an order that we are unable or unwilling to fulfil on the proposed commercial terms, including because of an incorrect price, unexpected delivery cost, inaccurate availability, an ineligible promotion or another legitimate operational or commercial reason. Our discretion applies before contractual acceptance and must be exercised lawfully.
If we cannot accept an order on its original terms, we may offer an alternative price, delivery service or other arrangement for your approval. We will not increase the amount payable without your express agreement. You are free to decline the revised offer. Any amount already collected for an unaccepted order will be refunded promptly, and we will explain the position without undue delay.
Where an address or consignment requires a delivery quotation, the quotation process is an enquiry only: it does not create an order or payment obligation. We will provide the available delivery arrangements and the proposed total price for your consideration before any order is accepted.
We may apply disclosed order-quantity limits, security checks or promotional eligibility conditions before accepting an order. We will not substitute materially different goods without agreement, and we will not use these provisions to restrict rights that cannot legally be excluded.
Once an order has been accepted, we cannot cancel it, alter its price or impose additional delivery charges merely because we would prefer different commercial terms. Any change to an accepted contract requires an appropriate contractual or legal basis and, where necessary, your express agreement.
4. Products, specifications and compatibility
We take reasonable care to describe goods accurately. Photographs help identify products but colours and finishes can appear different because of screen settings, lighting or changes in production. If a description or specification is materially wrong, we will address it in accordance with the contract and applicable legal rights.
Please check the published dimensions, rack format, usable depth, loading limits, mounting requirements, electrical ratings and compatibility information against your installation requirements. The Cabinet Finder, Cabinet Builder, product specifications, product Q&A and other technical guidance are intended to assist selection; they do not replace site-specific measurements, competent installation, safe working practices or compliance with applicable regulations.
The suitability of equipment may depend on the customer's existing equipment, physical clearances, fixings, loading, ventilation, site conditions, firmware or third-party components. Where customers provide drawings, measurements or other project information, they should take reasonable care to ensure those details are accurate and complete. We remain responsible for any contractual or statutory obligations that apply when we give advice or agree to supply goods for a stated purpose.
Do not exceed stated product ratings or disregard installation or safety instructions. Nothing in this section excludes rights that goods must be of satisfactory quality, as described and fit for purpose where applicable.
5. Prices, VAT and quotations
Prices may be shown excluding VAT and/or including VAT according to the page and customer context. Before a Consumer commits to an order, checkout will identify the total payable, including applicable VAT and mandatory delivery charges. Any charges that cannot reasonably be calculated in advance, and the circumstances in which they arise, will be explained before the customer is bound.
We aim to keep catalogue prices, discounts and delivery charges accurate, but product, supplier, promotion or system data may occasionally be incorrect or may no longer support supply on the displayed terms. Before accepting an order, we may decline it for legitimate commercial reasons, including an incorrect price, unexpected supply costs, misapplied discounts or an uneconomic delivery arrangement, and may offer revised terms for your approval. No revised price will be charged without your express consent.
Displayed prices, promotions and delivery estimates do not oblige us to accept every order. However, this does not give us an unrestricted right to cancel or change the price of an order we have already accepted, or to disregard applicable consumer law.
Discount codes, multi-buy prices and promotional offers are subject to their clearly stated validity periods, eligibility rules and disclosed limits. An unintended calculation or combination of promotions may be corrected before acceptance by offering the customer the correct terms. Genuine free products and authorised promotional discounts remain valid when their advertised conditions are met.
A trade or project quotation is valid for the period stated in that quotation. If goods or delivery require a separate quotation, the proposed total price and any special supply conditions will be confirmed for your agreement before the order is accepted. International freight, customs arrangements and applicable taxes will be explained where relevant.
We may update catalogue prices and promotions for future orders. An accepted Consumer order will not be unilaterally repriced without a lawful basis.
6. Payment and commercial credit
Orders made online must be paid using the payment methods shown at checkout unless we have expressly agreed another arrangement. We may use payment providers to process transactions securely. A payment authorisation, settlement or automated receipt is not, by itself, acceptance of an order where clause 3 says otherwise.
We may carry out proportionate fraud-prevention or payment checks and ask for reasonable verification before accepting an order, dispatching goods, changing a delivery destination, providing account information or processing a request to change refund arrangements. Where an order is under genuine review, we will communicate with the customer and respect all applicable legal rights and refund deadlines.
We will not treat knowledge of an order number, an email address or a request apparently sent from an account as conclusive proof of identity. For sensitive changes, we may verify details through an existing account or an independently established contact channel. Refunds will normally be made to the original payment method, subject to law and any expressly agreed and appropriately verified exception. We will not ask you to disclose passwords by email.
Trade credit, purchase-order facilities and invoice terms are available only where expressly approved and agreed. If credit is granted, invoices are payable according to the agreed terms; an online customer account does not itself establish a credit facility.
Where the Late Payment of Commercial Debts (Interest) Act 1998 applies, we may claim statutory interest and compensation for overdue Business Customer payments, subject to applicable law. This clause does not apply to consumer purchases.
7. Delivery, collection and risk
Delivery availability, charges and service information are explained on our Delivery Information page and during basket or checkout estimation. Standard or free delivery offers are limited to the products, delivery services and addresses expressly eligible for them. A qualifying basket value alone does not guarantee free delivery to every postcode. Any advertised minimum-spend threshold or standard delivery fee applies only where stated for the relevant order; such rates may be changed for future orders.
Remote, offshore and restricted destinations. Additional charges, a separate carrier service or a delivery quotation may be required for Northern Ireland, the Scottish Highlands, Scottish Islands (including Orkney and Shetland), the Isles of Scilly, the Isle of Man, the Channel Islands and other remote or offshore addresses. Eligibility is assessed against the actual destination, normally using its postcode and the goods to be shipped; boundaries and services may vary by carrier. The Isle of Man and Channel Islands are not included merely because an offer refers to the United Kingdom or mainland Great Britain.
Delivery quotation required. Some destinations and consignments, including oversized, overweight, multi-parcel or otherwise unsuitable shipments, cannot be reliably priced through standard checkout. Where the website shows that a quotation is required, the customer may request one through our basket, checkout or contact form. The enquiry is not an accepted order, and no payment is taken through that quotation-only route. We will explain the proposed carriage charge and delivery arrangement before asking the customer to agree to the complete order price.
Incorrect or unavailable delivery rates. If an incorrect delivery method or charge is identified before acceptance, we may decline the order on those terms and offer an alternative rate or service for the customer's approval. If the customer does not agree, we will not proceed with that proposed revised order and will promptly refund any payment taken for an unaccepted order. After a contract has been accepted, we will not impose additional charges or change the agreed delivery terms without a lawful basis and any consent required by law.
Service times. Next-working-day, 24-hour, timed and express delivery are available only where specifically offered for the products, order cut-off and destination concerned. Such services may not be available for Northern Ireland, Highlands, islands or other restricted areas. Delivery and dispatch dates are estimates unless we expressly agree to a guaranteed or essential date. We do not promise next-working-day service to every address.
Deliveries outside the supported UK checkout destinations are available only if expressly offered or agreed. International orders may require a quotation and separate arrangements for shipping, taxes and customs; no website-wide promise of international delivery is made.
Product stock indicators, supplier availability and dispatch estimates may change or occasionally be incorrect. If we cannot fulfil an accepted order or agreed delivery arrangement, we will contact you, explain lawful options and respect any applicable rights to cancellation, refund or other remedy. We will not substitute a materially different item without agreement.
Consumers: Unless another period is agreed, we will deliver within the period required by consumer law (normally within 30 days). If delivery is late, Consumers have applicable statutory rights and remedies. Risk of loss or damage normally passes when the Consumer, or a person they identify to receive the goods, takes physical possession, subject to applicable legal rules.
Business Customers: Unless otherwise agreed in writing, risk passes when goods are delivered to the agreed delivery destination or are collected by the Business Customer or their nominated carrier. Where a Business Customer causes a delivery or collection failure by providing incorrect instructions or failing to accept an agreed delivery, we may seek reasonable additional costs actually incurred, subject to the contract and applicable law.
For cabinets and other heavier items, please tell us about access restrictions, safe unloading requirements, delivery-site opening times and any other relevant constraints before placing an order. Please also tell us promptly if a delivery is missing, damaged or incorrect so that we can investigate; this request does not impose an arbitrary reporting deadline on Consumer statutory rights. Collection from our premises is available only where expressly agreed in advance.
8. Ownership of goods supplied to businesses
For Business Customers purchasing goods on credit, ownership of the goods supplied under the relevant invoice remains with Comlynx Communications Limited until the price of those goods has been paid in full in cleared funds, to the extent permitted by law.
Passing of risk and passing of ownership are separate matters. This clause does not give us an automatic right to enter premises or seize goods. Any recovery of unpaid goods will be pursued only through lawful arrangements and remedies.
Consumer ownership rights are governed by applicable law and the relevant contract.
9. Consumer cancellation rights for distance orders
If you are a Consumer buying goods online or through another qualifying distance sale, you normally have a legal right to cancel without giving a reason within 14 calendar days after receiving the goods. For an order containing goods delivered separately, the period normally runs from receipt of the final item. You can notify us of cancellation before delivery.
Tell us you wish to cancel by any clear statement, using the contact details above. You do not need a return authorisation or unopened product packaging to exercise the statutory cancellation right. A model cancellation form is provided at the end of these terms, but it is optional.
After notifying us of cancellation, you normally have a further 14 calendar days to send back the goods. Unless we agree otherwise or are legally responsible for the cost, you must arrange and pay the direct return carriage cost where this was disclosed before purchase. You may use a suitable postal or courier service, including one offering collection from your address. Please pack goods securely and retain dispatch evidence. The Returns & Refunds page explains the process and the returns address.
Where the statutory cancellation right applies, we will refund the sums due, including the cost of our least expensive standard outbound delivery option where required by law. We may withhold reimbursement until we receive the goods or evidence that they have been sent back, where permitted. Refunds are made without undue delay and within the relevant statutory deadline, normally no later than 14 days after receipt of the goods or earlier evidence of dispatch. We normally refund by the original payment method unless you expressly agree otherwise.
You may inspect goods as you reasonably would in a shop. If you handle goods beyond what is necessary to establish their nature, characteristics and functioning, a permitted deduction for diminished value may apply. No voluntary business restocking charge is imposed on statutory Consumer cancellations.
Certain exceptions apply to statutory change-of-mind cancellation, including some goods genuinely made to the Consumer's specifications or clearly personalised. Applicable statutory rights relating to faulty or misdescribed goods remain unaffected.
10. Voluntary business cancellations and returns
Business Customers do not have the statutory Consumer cooling-off right. Cancellation of an accepted Business Customer order before delivery requires our written agreement unless the contract or applicable law provides otherwise.
We offer a voluntary 14-day returns arrangement for eligible standard stock goods purchased for business purposes. The Business Customer must request return authorisation within 14 calendar days of delivery. Once authorised, goods must be dispatched within 14 calendar days of authorisation, unless a different period is agreed in writing.
For a voluntary business return to qualify, goods must be unused, uninstalled, unassembled, unmodified, complete and in their original, unopened, undamaged product packaging, with factory seals intact where applicable, and suitable for resale as new. Opening the outer courier transit carton solely to identify the product is acceptable provided the original product packaging has not been opened or damaged. An authorisation permits the goods to be sent for inspection; it does not guarantee acceptance or a refund.
Restocking charge: An accepted voluntary business return is subject to a deduction equal to 25% of the net selling value of the eligible goods returned, capped at £25 per authorised return, plus applicable VAT. The cap is before VAT: where the standard 20% rate applies, the maximum amount retained is £30 including VAT. The calculation excludes the original delivery charge. We will apply the VAT treatment and issue any required refund or credit documentation in accordance with applicable tax rules. Original outbound delivery charges are not normally refunded for voluntary business change-of-mind returns.
The Business Customer must arrange and pay for return carriage using a suitable service and adequate protective packaging. The Business Customer is responsible for arranging return carriage; we do not undertake to arrange courier collections for voluntary returns. For customer-arranged voluntary returns, the customer bears the risk of loss or damage in return transit until the goods are delivered to our returns address. Returns are inspected on receipt; if goods arrive damaged, opened, incomplete or otherwise unsuitable for resale as new, we may decline the voluntary return and refund. We will explain a rejection and provide supporting information where appropriate. The Business Customer must arrange and pay for onward collection of rejected goods. We will discuss arrangements before taking any further action in relation to uncollected goods.
Bespoke, modified or specially procured goods may be excluded from voluntary returns where non-returnable terms were clearly agreed before purchase. A standard catalogue product is not automatically a special order merely because it is temporarily out of stock.
Not quite right? Let's talk. Before arranging a return, please contact our team. We may be able to offer practical advice or discuss a sensible alternative. This does not promise any particular concession or remove the conditions above. The voluntary business rules do not apply to Consumer statutory cancellations or valid claims concerning faulty, damaged or incorrectly supplied goods.
For the full return procedure and address, see Returns & Refunds.
11. Faulty, damaged, missing or incorrect goods
Consumers: Goods must meet statutory requirements, including being of satisfactory quality, as described and fit for purpose where applicable. Depending on the circumstances and timing, remedies may include the short-term right to reject, repair or replacement, a price reduction or the final right to reject. These rights are separate from change-of-mind cancellation and are not restricted by the unopened-packaging or restocking provisions for Business Customers.
Business Customers: Applicable contractual warranties and rights under sale-of-goods law apply. Business Customers should inspect deliveries within a reasonable period and notify us promptly of apparent shortages, damage or defects. A late notification does not automatically remove rights that cannot lawfully be excluded.
If an order arrives damaged, incomplete or incorrect, please send the order number, SKU, a description of the problem and photographs where useful. We will investigate and arrange the appropriate remedy in accordance with the contract and applicable law. Where we are responsible for faulty or incorrectly supplied goods, the voluntary restocking charge does not apply. Consumers will not be required to bear return costs that the law requires us to bear.
12. Product and manufacturer warranties
Product warranty periods and terms may vary. Any express warranty supplied with a product, or described on the product page, is subject to its applicable conditions. Manufacturer and commercial warranties are additional to, and do not replace, any Consumer statutory rights.
Warranties may exclude defects attributable to accidental damage, misuse, unauthorised modification, unsuitable installation, use outside stated ratings or normal wear and tear, where the applicable warranty terms lawfully provide. Please contact us if you need help establishing a warranty or statutory remedy.
13. Bespoke and special-order goods
Where we agree to manufacture, customise, brand, modify or procure goods specifically for a customer, the quotation or order acceptance may contain additional terms, including agreed specifications, approval stages, lead times and any cancellation restrictions. Any special commercial obligations or non-returnable status must be made clear and agreed before the order is accepted.
The customer should carefully check and approve any specifications, measurements, technical drawings, artwork and compatibility requirements they provide. We will seek clarification where necessary and remain responsible for our own contractual and statutory obligations. A standard catalogue product is not automatically a special order merely because it is out of stock.
For Consumers, the statutory cancellation exception for made-to-specification or clearly personalised goods applies only where the legal conditions for the exception are satisfied. Consumer rights concerning faulty or misdescribed goods remain unaffected.
14. Our responsibility to Consumers
We do not exclude or limit liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or liabilities and statutory remedies that cannot legally be restricted.
We are responsible for foreseeable loss or damage caused by our breach of contract or failure to exercise reasonable care and skill, subject to applicable law. Loss is foreseeable if it was an obvious consequence of the breach or was within the contemplation of both parties when the contract was made.
We are not responsible for business losses arising from goods bought by a Consumer for private use, but this does not limit any non-excludable Consumer rights.
15. Our responsibility to Business Customers
The provisions in this section apply only to Business Customers.
Nothing in these terms excludes or restricts liability for death or personal injury caused by negligence; fraud or fraudulent misrepresentation; breach of the statutory undertakings as to title to goods; liability that cannot be restricted under Part I of the Consumer Protection Act 1987; or any other liability that cannot lawfully be excluded or limited.
Subject to the paragraph above and the reasonableness requirements of applicable law, we will not be liable for a Business Customer's loss of profit, revenue, production, anticipated savings, contracts, business opportunity or goodwill, or for indirect or consequential loss, in each case to the extent the particular exclusion is legally enforceable.
Subject to the liabilities that cannot lawfully be limited, our total aggregate liability to a Business Customer arising out of or in connection with any one accepted order, whether in contract, negligence or otherwise, will not exceed the greater of £10,000 and the net value of the goods under that order (excluding VAT and delivery charges). All claims arising out of the same order count towards one aggregate cap, not a separate cap for each claim.
Nothing in this section prevents a Business Customer from receiving any refund, replacement, repair or other remedy to which they are entitled under applicable law to the extent that remedy cannot lawfully be excluded or restricted.
If a particular project or supply arrangement requires different commercial protections or a higher liability limit, these may be agreed expressly in writing before acceptance of the order. A separate, individually agreed provision will take precedence to the extent lawfully enforceable.
16. Events beyond reasonable control
We are not responsible for failure or delay caused by circumstances beyond our reasonable control to the extent permitted by law. We will take reasonable steps to mitigate the effect and communicate with affected customers where appropriate.
This clause does not remove any Consumer rights relating to late delivery, refunds or cancellation that cannot be excluded.
17. Website use and intellectual property
Unless otherwise stated, content on this website, including text, design, product photography, databases and software, is owned by or licensed to Comlynx Communications Limited. Third-party trade marks and product names belong to their respective owners.
You may use the website for lawful shopping, technical research and account management. You must not interfere with its security, gain unauthorised access, introduce malicious code, knowingly exploit technical faults in the ordering process, misuse another person's account, or use automated activity that materially disrupts the service. We may take proportionate steps to investigate suspected misuse, protect accounts or prevent fraudulent orders, consistently with applicable law.
Product content must not be reproduced in ways that infringe intellectual-property or database rights. These provisions do not restrict legitimate lawful browsing, permitted uses of product information, security reporting or any statutory rights. Website-security measures do not change the separate rules about acceptance and cancellation of orders.
18. Personal information and cookies
We process personal information as explained in our Privacy Policy and use cookies or similar storage as explained in our Cookie Policy. You can review optional choices through the Cookie settings control in the footer.
19. Complaints and dispute resolution
If there is a problem, please contact our team so that we can investigate and try to resolve it promptly.
When we communicate the outcome of our consideration of a Consumer complaint, we will provide information about any alternative dispute resolution (ADR) or other arrangement available to that Consumer if they remain dissatisfied, as required by applicable law. We do not claim to belong to any particular ADR scheme or undertake to participate unless we are obliged to do so or agree to it.
You may also obtain independent advice about your rights. Nothing in this section removes the right to bring proceedings in a court with jurisdiction.
20. Changes, governing law and general provisions
The version of these terms incorporated into a contract when the order is accepted applies to that order. We may update terms for future orders; we will not retrospectively change an existing accepted contract without a lawful basis and, where necessary, agreement.
Where required, we will provide contract and order information in a form that can be stored or reproduced. Order communications may be provided electronically using the contact details supplied, subject to applicable law. Customers should ensure their order information is correct and notify us if a communication appears missing or wrong.
If part of these terms is found to be unenforceable, the other provisions remain effective to the extent allowed by law. A failure to enforce a provision on one occasion is not necessarily a waiver of future rights.
Contracts are governed by the laws of England and Wales, subject to mandatory consumer protections. Consumers may have the right to bring proceedings in the courts of the part of the United Kingdom in which they live. For Business Customers, the courts of England and Wales have exclusive jurisdiction unless expressly agreed otherwise in writing.
21. Model consumer cancellation form
You may use this form to tell us you are cancelling a qualifying Consumer distance contract, but you do not have to use it. Any clear cancellation statement is sufficient.
